EL CAJON DUI ATTORNEY - CRIMINAL LAWYER
MICHAEL REHM - (619) 787-3456
In the most recent year for which statistics are available, 139 drivers were arrested for DUI in El Cajon. The Office of Traffic Safety compared El Cajon to 58 California cities of similar size. The OTS determined that El Cajon had the 11th highest DUI arrest rate among those cities.
Those statistics were compiled before the pandemic. There is some evidence that DUI arrests in San Diego County actually increased during the pandemic, as a reduction in overall crime rates and less traffic made it easier for police officers to target drivers whose minor deviations from “normal” driving would usually be overlooked.
An arrest is usually followed by a breath test at an El Cajon Police Department or the sheriff's office. Testing “over the limit” usually results in the driver being booked. Male drivers are usually booked at the Las Colinas Detention Facility in Santee. Female drivers are typically booked at the Vista Detention Facility in Vista.
DUI Charges in El Cajon
After reviewing police reports and test results, a prosecutor in the San Diego District Attorney's office will decide what charges to file. Most drivers are charged with a misdemeanor DUI and an “over the limit” charge. About 5% of DUI cases in San Diego County are charged as felonies.
Charges are filed in the San Diego County Superior Court. Although the case could be assigned to a different courthouse, court appearances for a DUI arrest in El Cajon will usually be made at the East County Regional Center at 250 East Main Street in El Cajon.
DUI Convictions in El Cajon
The best outcome in a DUI case is to avoid a conviction. Drivers who obtain counsel (private attorney or public defender) have a much greater likelihood of achieving a favorable result. El Cajon DUI Attorney Michael Rehm can evaluate your case and suggest the best strategy for mounting a defense.
Many drivers believe that a conviction for DUI is a foregone conclusion. They plead guilty at the earliest opportunity, assuring that a conviction will occur. Statistics make clear that many drivers avoid DUI convictions in San Diego County.
In the most recent year for which the DMV has released statistics, only 77.3% of DUI charges in San Diego County resulted in a DUI conviction. The next most likely disposition was a reduced charge. About 10.6% of drivers were found guilty of a “wet” reckless, a reckless driving charge that generally results in lesser penalties than a DUI conviction. Another 1.6% of drivers were found guilty of some other reduced charge.
The remaining drivers (about 10.5% of the total) were not convicted of any crime at all. In most of those cases, defense lawyers persuaded a court to dismiss the charges or to throw out the evidence. In other cases, DUI defense attorneys(this includes Public Defenders) obtained not guilty verdicts for their clients.
