When probation was not granted, the statute that controls is Penal Code 1203.4a. In order to be eligible for relief under this statute the offense of which a conviction ensued must be either a misdemeanor or infraction and:
– The individual must have fully complied with and performed the sentence the court gave.
– Must not be serving any other sentence
– Must not be charged with any crime
– And since conviction, must have “lived an honest and upright life,” basically obeying the law.
