Except as authorized by law, every person who possesses not more than 28.5 grams of marijuana, other than concentrated cannabis, is guilty of an infraction punishable by a fine of not more than one hundred dollars ($100)
This code section covers possession of marijuana as an infraction. A marijuana possession offense will be an infraction if the defendant possessed less than 28.5 grams of marijuana.Of course, any possession of marijuana charge has to do with Proposition 215. See information on the Prop 215 page.
In order to secure a conviction on this offense, the prosecutor must prove the same elements as listed under Health and Safety Code 11357(c).
