California is the only state that expressly permits lane splitting. Helmet Defense

California Vehicle Code section 27803 requires motorcycle riders and passengers to wear helmets meeting federal safety standards. Where a rider was not wearing a helmet, the defense will argue that the failure to wear a helmet caused or aggravated the head injuries at issue. This argument is relevant to causation of head injuries specifically — it does not reduce liability for injuries to other body parts unrelated to helmet use.
