Extended Window to File a Claim

In 2019, California implemented The Child Victims Act, which, among other things, provided survivors a new opportunity to file a claim against their abuser and anyone else responsible for the abuse, even if the statute of limitations has already passed. For 3 years, ending on December 31, 2022, anyone can file a civil claim for childhood sexual abuse, regardless of when it occurred, how old the victim was when it occurred, and how old the victim is now. If you missed your chance to file a claim and now wish to hold your abuser accountable in court, this gives you that opportunity.

Claims Can Be Filed Against Individuals or Organizations

The Child Victims Act has produced many lawsuits against organizations and religious institutions, such as The Boy Scouts and Catholic churches. These are typically the only cases we hear about on the news, as suing a church or an organization is incredibly significant. It's certainly worth mentioning, though, that The Child Victims Act and the revival of potential civil claims is applicable to any childhood sexual abuse. This means that if you were abused by a neighbor or someone who has no affiliation with any organization, you can now file a lawsuit against this individual.

Child Sexual Abuse Cases in Humboldt County

It's probably not news to anyone that the Catholic church is at the center of many child sexual abuse cases. It is unfortunately incredibly common – and now almost expected – that when a priest sexually abuses a child, the diocese helps cover it up rather than reporting it and holding the priest accountable. In situations like this, the church is as responsible for the behavior as the abuser. Unfortunately, Humboldt County became a dumping ground for priests accused of sexual abuse of children. Instead of reporting the priests and taking the right steps, the dioceses would simply transfer them to Humboldt County, where they continued to abuse children in their role in the church.

One theory is that the churches simply move the priests to areas where the population is more vulnerable and less likely to complain about any illegal and inappropriate behavior, such as immigrant communities, inner cities, and poor, rural communities. But whatever the reason may be, it is simply unacceptable, and the victims of such heinous conduct deserve financial compensation.

There are many important factors to consider when deciding if you want to file a civil lawsuit. It can be stressful, time consuming, expensive, and scary. It's important to weigh the pros and cons before you begin. Some people see lawsuits or compensation from childhood sexual abuse as the main goal, but these types of cases are about more than just money. Your abuser should be held accountable, and so should the system that protected them and allowed the abuse to continue. An experienced attorney can help you do this.
