Expanded Window to File Civil Claims
The California Child Victims Act (The Act) was implemented in 2019 as a way to help childhood sexual abuse survivors seek justice for incidents that occurred outside of the statute of limitations. For 3 years, The Act allowed any individual who suffered from childhood sexual abuse – regardless of where it occurred, when it occurred, and how old the survivor is – file a civil claim. It is notoriously difficult for sexual abuse survivors to come forward, as they are often not taken seriously; it seems that most institutions care more about their reputation than addressing what occurred. The Act revived hundreds of potential civil claims in California, giving survivors a second chance at justice.
Until December 21, 2022, any childhood sexual abuse survivor is within the timeframe to file a civil claim.
Broadened Definition of Child Sexual Abuse
In addition to expanding the window of time to file a civil case, The Act also broadened the definition of child sexual abuse, opening up the possibility of a civil claim to even more individuals. Once The Act was implemented, it changed childhood sexual abuse to childhood sexual assault. The Act defines childhood sexual as any act committed against the victim when they were under the age of 18, and which would have been labeled as a criminal act under most relevant sections of the California Penal Code. This change adds to the list of crimes that are considered child sexual abuse.
