Child sexual abuse is something that no one should ever have to experience. Unfortunately, it happens far more than we realize, and it can have lifelong consequences for the victim and their family. The unfortunate reality is that many victims feel ashamed of what happened even though it wasn't their fault, leading them to keep the incident to themselves instead of reporting it to the appropriate authorities. California implemented a new law that gives these victims another chance to speak out, hold their abuser accountable, and recover monetary compensation if they wish. If you're wondering if you are eligible to file a childhood sexual abuse case, help is available. For a free and confidential consultation, contact The Law Office of Michael Rehm today at (415) 251-1680.
Expanded Window to File Civil Claims
On January 1st, 2020, the state of California implemented a new law giving childhood sexual abuse survivors another opportunity to file civil claims against their perpetrators (or the organizations responsible for the perpetrator's behavior) even if the statute of limitations had long passed. For 3 years from the date of implementation, survivors of all ages can bring these lawsuits, regardless of their age, when the abuse occurred, and how old they were when the abuse occurred.
Schools Can Be Liable
Many people are sometimes confused as to why the school should be responsible for the actions of one of its coaches or teachers. Many times the school knew of complaints regarding sexually inappropriate and illegal behavior on behalf of a teacher/coach, and they not only failed to do anything about it, but they concealed it and allow the teacher/coach to continue working with young students.
Schools have responsibilities to their students, and there are steps they must take to protect their students. When a school fails to take adequate security precautions to protect its students, fails to set clear requirements for student-teacher interactions, or allows a teacher to continue working despite past allegations, they can be held liable for the coach or teacher's conduct. Parents entrust their children's safety to the school, and the very least they can do is address illegal behavior committed by employees they chose to hire.
