San Marcos boasts of its excellent transportation network. Six interchanges provide access to Highway 78. The busy highway runs through the middle of the city.

Unfortunately, the transportation advantages offered by a major highway are balanced by the city's rate of traffic accidents. San Marcos had 300 motor vehicle crashes causing injury or death in the most recent annual statistics furnished by the Office of Traffic Safety (OTS).

A recent report by the non-profit group Circulate San Diego examined the most crash-prone intersections in North County. It found that Highway 78 and Las Posas Road in San Marcos was one of the area's most dangerous intersections.

San Marcos Traffic Accident Statistics

In the most recent year analyzed by OTS, twenty-three San Marcos traffic accidents involved motorcycles. San Marcos had the 22nd highest rate of motorcycle accidents among 106 cities of comparable size, after adjusting for miles driven. Motorcycle accidents are more likely to cause serious and fatal injuries than collisions involving two cars, simply because car occupants are surrounded by steel while motorcycle riders rely on their helmet and riding gear for protection.

Data from OTS reveals that in that same year, 22 pedestrians and 17 bicyclists were injured or killed in San Marcos traffic accidents. The OTS ranks San Marcos in the middle of the 106 comparable cities with regard to both pedestrian and bicycle accidents.

Hit-and-run collisions accounted for 23 San Marcos injuries or deaths. Alcohol consumption was a factor in 36 collisions. In both of those statistics, OTS ranked San Marcos 44th of 106 cities, suggesting the need for better traffic enforcement.

San Marcos Accident Attorney Michael Rehm can help car occupants, motorcycle riders, pedestrians, and bicyclists who are injured in a San Marcos traffic accident. Attorney Rehm also help families bring wrongful death claims when a loved one is killed by a negligent driver.

San Marcos Traffic Accident Lawsuits

Most insurance claims against negligent drivers in San Marcos are settled out of court. If they can be settled within two years of the accident, it is often unnecessary to file a lawsuit.

When a lawsuit must be filed against a careless driver who caused a collision in San Marcos, it will be filed with the San Diego County Superior Court. The court has several courthouses, but civil suits based on negligent acts in San Marcos are usually heard in the North County Regional Center in Vista.

Even after a lawsuit is filed, most cases are settled without a trial. In the most recent fiscal year for which statistics are available, almost 2,800 motor vehicle accident lawsuits in San Diego County were resolved. Only 40 of those were decided by a jury.

Accident victims can expect some delay if their case does not settle. About 3,000 motor vehicle accidents were filed in San Diego County in the most recent fiscal year. Backlogs occur when cases are filed more quickly than they are resolved.

Still, about 77% of San Diego County motor vehicle accident lawsuits are resolved within one year of filing, and 82% are resolved within two years. Some cases settle more quickly than others, but nearly all cases eventually settle or proceed to trial.
